Jack Smith Biography

Jack Smith (born John Luman Smith) is a well-known American attorney who has served as an assistant U.S. attorney, acting U.S. attorney, and head of the department’s Public Integrity Section in the United States Department of Justice. Also, he was the chief prosecutor at the Kosovo Specialist Chamber. Attorney General Merrick Garland appointed Smith in November 2022 as an independent special counsel, responsible for overseeing two preexisting Justice Department criminal investigations into former President Donald Trump.

One regarding Trump’s role in the January 6 U.S. Capitol attack and the other into alleged mishandling of government records, including classified documents. The second resulted in a 37-count indictment of Trump in June 2023 to which later three counts were added in July. In August, the former resulted in an indictment on four charges. On August 3, 2023, Smith summoned Donald Trump to court to face a second federal criminal indictment. On August 1, 2023, Smith secured a grand jury indictment of Trump charging him with crimes including conspiracy and witness tampering for Trump’s efforts to overturn his 2020 election loss to Democratic now President Joe Biden, which Trump continues to falsely claim was the result of fraud.

After graduating from high school, he attended The State University of New York at Oneonta where he graduated in 1991 with a Bachelor of Arts, summa cum laude. He joined the Manhattan District Attorney’s office after graduating from law school. There, he served as an assistant district attorney. As an assistant U.S. attorney at the Brooklyn-based office, he prosecuted the police officers who brutalized and sexually assaulted Abner Louima. Smith then worked as an investigation coordinator for the Office of the Prosecutor of the International Criminal Court in The Hague, Netherlands from 2008 to 2010. In that position, he oversaw cases against government officials and militia members accused of war crimes and genocide. He then returned to the U.S. in 2010 to become chief of the U.S. Department of Justice’s Public Integrity Section (PIN). He spent five years as Chief of PIN where he prosecuted a variety of corruption cases including those against Virginia governor Bob McDonnell, U.S. representative Rick Renzi, New York State Assembly Speaker Sheldon Silver, and Jeffrey Sterling, a Central Intelligence Agency agent who shared national secrets. He went on to become an assistant U.S. attorney in the Middle District of Tennessee, at Nashville in 2015.

Upon the resignation of David Rivera in March 2017, he became an acting U.S. attorney and resigned effective in September 2017, after the nomination of Donald Q. Cochran. In 2017, he became the vice president and head of litigation for Hospital Corporation of America. Smith was named to a four-year term as chief prosecutor for the Kosovo Specialist Chambers in The Hague on May 7, 2018, investigating war crimes in the Kosovo War, including the case of Salih Mustafa. On September 11. 2018, he took up the post and was appointed to a second term on May 8, 2022, before stepping down on November 18, 2022.
