John Kapoor is an American multi-millionaire, pharmaceutical entrepreneur, former CEO of Insys Therapeutics, and majority shareholder in the generic drug manufacturing company Akorn.

Kapoor began his career in 1972 at Invenex Pharmaceutical on Grand Island, NY. He worked his way up at LyphoMed, took the company public, and oversaw its operations through a scandal involving lax production standards that resulted in several patients’ deaths. In the fall of 2017, he was arrested and charged with numerous felony counts including RICO conspiracy, conspiracy to commit wire fraud and other crimes. In June 2019, Kapoor was found guilty on all counts.

John Kapoor Arrested

Kapoor was arrested in Arizona in October 2017 and charged with RICO conspiracy, conspiracy to commit wirefraud, and conspiracy to violate the Anti-Kickback Law. The charges stem from allegations that Kapoor participated in a scheme to bribe doctors to prescribe fentanyl, a powerful synthetic opioid manufactured under the brand name Subsys by his company Insys Therapeutics. U.S. Attorney William Weinreb said the charges reflected authorities’ commitment to combat the opioid epidemic.

John Kapoor is also alleged to have conspired to defraud health insurance providers. Shortly after the charges were announced, he resigned from the Board of Insys Therapeutics. On May 2, 2019, he was convicted of engaging in a racketeering conspiracy to increase the profits of his company’s opiate painkiller, Subsys.

On January 23, 2020, Kapoor was sentenced to five-and-a-half years in prison in a Boston courtroom for his role in a conspiracy to bribe doctors to prescribe his company’s potent fentanyl painkiller to patients who didn’t need it. The company’s former vice president of sales, Alec Burlakoff, was sentenced to 26 months in prison as well.

On Wednesday, the former CEO Michael Babich was sentenced to 30 months in prison and a former regional sales director, Sunrise Lee, was sentenced to one year in prison. Before Kapoor’s trial started Babich and Burlakoff pleaded guilty to their roles in the scheme to bribe doctors to prescribe Insys’ fentanyl spray.

Kapoor’s 66-month prison term is substantially less than the 15-year sentence recommended by federal prosecutors, but it is more than the one year requested by his defense attorneys, who maintained the executive’s innocence and stressed his old age as the reason for a short prison sentence. U.S. District Judge Allison Burroughs explained that she reached the lesser sentence after considering Kapoor’s advanced age and philanthropy, as well as “his central role in the crime,” The Associated Press reported.
